[00:02:06] If you would, Francisco, welcome. [00:02:19] My name is Francisco Linarees. I'm the [00:02:21] new executive director. Uh when our [00:02:24] founder, Christy Porter, retired last [00:02:26] year, I was honored to step into the [00:02:28] role. I've been with Hidden Harvest for [00:02:31] the past 20 years. Um starting from the [00:02:34] ground as an employee. In that time, [00:02:37] I've seen the difference fresh, healthy [00:02:39] food makes for our seniors and families [00:02:41] across the Coachella Valley. [00:02:44] About Hidden Harvest, Hidden Harvest [00:02:47] exists to makes fresh produce free and [00:02:50] accessible to our neighbors who need it [00:02:51] most. Uh we have our senior markets. We [00:02:54] have three programs. One of them is our [00:02:56] senior markets, which we bring a pop-up [00:02:59] farmers market style distribution [00:03:01] directly to um affordable housing sites. [00:03:05] uh senior centers across the Coachella [00:03:07] Valley uh where seniors choose from [00:03:09] seasonal fruits and vegetables always [00:03:12] free, dignified, and easy to access. [00:03:14] These markets stretched tight budgets [00:03:16] and support better health food for our [00:03:18] most vulnerable groups. Um we just we're [00:03:22] starting next week a senior market here [00:03:24] in Rancho Mirage. So, we wanted the [00:03:27] community to know we're going to be out [00:03:28] there and we're starting with Park Park [00:03:31] View Villas and there's other neighbor [00:03:34] um communities uh of housing there we [00:03:39] want to try to get into. We just [00:03:40] purchased a new refrigerator truck to be [00:03:42] able to transport all this fresh produce [00:03:45] uh to actually be fresh for them. Um the [00:03:50] other community partners that we have is [00:03:52] uh uh who we distribute produce to is [00:03:57] Joselin Center fine food bank. Uh this [00:04:00] is produce that we rescue from local [00:04:02] packing houses here in the valley. Um [00:04:05] any surplus that they have. We also have [00:04:08] another program which is a small farmers [00:04:10] program where we go and hire small [00:04:14] farmers who have an acre or more and [00:04:19] we tell them what we need for our [00:04:20] seniors uh what kind of plants we buy [00:04:23] the seed or or transplants for them. [00:04:25] They put them on the ground and when [00:04:27] it's time to harvest we pay them to [00:04:29] harvest it and we buy it um uh [00:04:34] market price. So donations that we get [00:04:37] and everything stays here in the in the [00:04:39] valley. Uh and our produce is actually [00:04:42] grown here. So those are some of the [00:04:44] programs that we have. Um [00:04:49] with Ranch Mirage, we would like I would [00:04:51] like to give you guys some an [00:04:52] invitation. We are having a uh a lunchon [00:04:57] uh in November the 20th which we would [00:05:00] like if you guys we love to have you. [00:05:02] It's it's a lunchon fashion show and [00:05:05] silent auction in Awa Caliente. [00:05:08] Um it's November 20th. It's it's a this [00:05:13] event directly funds more produce for [00:05:16] our seniors families. And if you could [00:05:18] attend and sponsor a table or donate an [00:05:21] auction item, you'll be putting fresh [00:05:23] food into local kitchens right away. I know I will be [00:06:25] most welcoming to um to all of our [00:06:29] commissioners who have either joined or [00:06:32] been uh reassigned to their commissions, [00:06:36] thank you for uh volunteering your time. [00:06:39] We have a busy season [00:06:41] before us and uh we're just going to say [00:06:44] thank you ahead of time. I've received since some [00:07:51] changes have been made and you've been [00:07:52] involved with the community, I've had [00:07:55] several people talk about how happy they [00:07:57] are with the quality of the food, with [00:07:59] the amount of the food. [00:10:40] As you know, uh the library in Rancher [00:10:44] is literally worldclass [00:10:46] and it has a [00:10:48] variety of programs uh that are going on [00:10:52] virtually daily for all age groups, [00:10:56] whether it be children up through [00:10:58] seniors. Uh it is an incredible asset [00:11:02] that we have and we're most proud of it. [00:11:05] I'd also like to commend uh the [00:11:09] sheriff's department and uh uh initially [00:11:14] for the amount of effort that they put [00:11:16] out over uh they they do it every day, [00:11:20] but in this case it was over uh the [00:11:24] Labor Day holiday. the amount of [00:11:28] visible vehicles you had out and uh [00:11:33] frankly [00:11:35] uh motorcycles was overwhelming. I have [00:11:37] one friend that said, "What's going on?" [00:11:40] Um he said, "Boy, am I careful as far as [00:11:43] I driving is concerned. It is a [00:11:47] challenging holiday as we know and uh [00:11:53] constitutes [00:11:54] sadly a number of DUIs and so therefore [00:11:58] was in need of additional sheriffs out. [00:12:01] So thank you and again Cal Fire thank [00:12:05] you for standing by to the degree that [00:12:07] you do uh for self helping so many [00:12:11] people in need. uh we have a community [00:12:15] uh where the dem demographics dictate uh [00:12:18] that your services are needed uh [00:12:22] regularly. So again, we thank you for [00:12:24] your service uh beyond compare. [00:12:28] Um [00:12:30] that being said, we will now go to the [00:12:32] city manager. Brad Anderson, City [00:12:47] of An I'm delighted to be here and I [00:12:50] wanted to speak on what you just spoke [00:12:52] about uh uh the uh public services of [00:12:55] police and fire and I agree uh they are [00:12:58] outstanding in our city and I've seen [00:13:00] them noticeably on Highway 111. uh [00:13:03] hopefully not doing uh speed enforcement [00:13:06] or radar type uh actions but just [00:13:09] slowing traffic down by the mere [00:13:11] presence uh is is delightful to know [00:13:14] that they are uh I guess interacting [00:13:18] with the public in that in that matter. [00:13:20] So I'm with you. I I support our police [00:13:23] and fire and I have no arguments of the [00:13:26] uh the enforcement actions that they're [00:13:28] doing in the city. Thank you. So uh I'll go [00:13:40] ahead and move on to our consent [00:13:42] calendar agenda item number five. Uh the [00:13:45] council has 12 items on the consent [00:13:48] calendar for consideration. Items 5A [00:13:52] through 5 L. Uh item 5 A is to wave the [00:13:56] full reading of any ordinance introduced [00:13:59] or adopted pursuant to this agenda. Item [00:14:03] 5B is to uh adopt ordinance number 1225 [00:14:09] uh zoning text amendment case number [00:14:12] ZTA25-00002 [00:14:17] uh amending chapter 17.30 30 section [00:14:22] 17.30.27D [00:14:25] penalty uh of the Ranch Mirage Municipal [00:14:28] Code. Item 5 C are your July 17th, 2025 [00:14:34] regular city council meeting minutes. [00:14:36] Item 5D [00:14:38] is to appoint Mr. Hill to the Rancho [00:14:42] Mirage Mobile Home Fair Practices [00:14:44] Commission. Item 5E is to uh authorize [00:14:49] uh opioid settlement agreements with [00:14:52] Purdue Sackler and the approval and [00:14:54] execution of future opioid settlement [00:14:57] agreements. Item 5 is the approval of [00:15:01] the Rancho Mirage Energy Authority 2024 [00:15:05] power source disclosure. Item 5 D G, [00:15:09] excuse me, is authorization for the city [00:15:12] manager to procure six level three DC [00:15:17] fast charging units as part of the [00:15:20] Southern California Edison charge ready [00:15:22] funding grant program. [00:15:25] Item 5 FH is uh amend uh approval of the [00:15:29] amendment of the recognized obligation [00:15:32] payment schedules for fiscal year 2025 [00:15:36] 2026. [00:15:38] Item 5 I is to approve the updated [00:15:42] calendar year 2025 salary schedule. [00:15:46] Item 5J is the receive and file of the [00:15:50] quarterly treasures report for the [00:15:53] quarter ending June 30th, 2025. [00:15:56] Item 5K are contracts. I think that may be I did [00:16:35] write some comments on some of them [00:16:36] earlier uh uh for the public record. Uh [00:16:40] but maybe in the future on certain [00:16:43] selective items, maybe reading them [00:16:46] aloud into the public record so the [00:16:48] people at home uh that don't go through [00:16:51] the thousands of pages normally of a [00:16:53] city council agenda packet would know [00:16:56] exactly what's going on. Uh and item 5B, [00:16:59] this is a second reading of ordinance to [00:17:02] uh really I guess pointed at short-term [00:17:05] renders. Most people probably don't know [00:17:06] that of a tier play system for penalties [00:17:09] and fines and fines and and I did oppose [00:17:13] that and I still do. And item 5C is the [00:17:16] city minutes which I can go into detail [00:17:19] but I won't. Uh the city has changed how [00:17:22] they record the written minutes meaning [00:17:24] they don't record like my minutes my my [00:17:27] public comments won't be uh my won't be [00:17:31] recorded uh accurately. Maybe just my [00:17:34] name. Maybe that will be the only thing. [00:17:36] And also that goes right back to the [00:17:38] minutes. I believe um the last consent [00:17:42] calendar that I spoke on, it was written [00:17:44] down that was non-aggenda public [00:17:45] comments. Again, it's just a [00:17:47] technicality, but if we're going to do [00:17:49] this, we might as well do it right and [00:17:51] and maybe adjust that. And I'm going to [00:17:54] go on to 5F. I believe [00:17:58] it's 5F. And that's the power authority [00:18:00] with the Southern California Anderson. I [00:18:02] believe you're buying some juice from [00:18:03] them. Meaning Paul, um I know the city [00:18:07] manager, not to throw him under the bus, [00:18:08] but he has said he's not a fan of sudden [00:18:12] cover Anderson and and and we rely on [00:18:15] them. Uh so I think maybe um keeping the [00:18:19] well [00:18:20] I guess u we need Southern California [00:18:23] Anderson. So maybe we can uh uh look at [00:18:27] them as peers and uh and act accordingly [00:18:30] to that. and five I update this calendar [00:18:34] year salary schedule. I think that all [00:18:38] goes back to the city clerk. At the last [00:18:40] meeting in July, I did write some public [00:18:42] comments concerning this where there was [00:18:45] agenda item after close session and uh I [00:18:49] wasn't be I wasn't allowed to speak [00:18:52] before the uh official report was read. [00:18:55] Uh and and that's that's an issue. [00:18:57] That's uh that's like silent not [00:19:00] silencing but not letting the public [00:19:02] comment or even know about agenda items. We'll now go to the public [00:19:56] hearings and the first item [00:19:59] is item 6A and it's a resolution [00:20:02] amending the vehicle impound cost [00:20:05] recovery fee and adopting a DUI vehicle [00:20:10] impound cost recovery fee. Tyler Folks, [00:20:14] our senior management analyst. Tyler, if [00:20:17] you would, please. [00:20:19] >> Thank you, Mayor. Good afternoon, mayor [00:20:22] and members of the city council. The [00:20:24] item before you today is a proposed [00:20:26] amendment to the city's vehicle impound [00:20:28] cost recovery fee and the adoption of a [00:20:30] new DUI impound cost recovery fee. [00:20:33] The vehicle impound cost recovery fee or [00:20:36] vicer is a fee that the city charges [00:20:38] when law enforcement impounds a vehicle. [00:20:41] It covers the administrative costs of [00:20:43] the impound such as deputy time, [00:20:46] paperwork, coordinating with tow [00:20:47] operators, and clerical processing. [00:20:50] Importantly, it is not designated to [00:20:53] generate revenue. It is only used to [00:20:55] reimburse the city for actual costs [00:20:57] incurred. [00:20:59] The vicer fee for the city of [00:21:00] Rancharrage was first established in [00:21:02] 2001 at $75 and then raised once in 2010 [00:21:07] to $145. [00:21:09] It has not been updated in over 15 [00:21:11] years, even though the costs for law [00:21:13] enforcement services have risen [00:21:15] significantly. [00:21:17] State law allows cities to recover the [00:21:20] actual costs of impoundments, but [00:21:22] requires that such fees not exceed those [00:21:24] costs. Staff's review shows that the [00:21:27] current $145 fee no longer covers the [00:21:30] city's expenses. Additionally, DUI [00:21:33] related impounds require substantially [00:21:35] more law enforcement time, testing, and [00:21:38] reporting than a standard impound, [00:21:40] necessitating its own fee structure. [00:21:44] Considering this information, staff [00:21:46] recommends a two-tier fee structure, [00:21:48] which includes a base rate for all [00:21:51] vehicle impounds increased from 145 to [00:21:54] 229 and the establishment of a DUI DUI [00:21:58] impound fee of 11.47. [00:22:01] These figures are based directly on [00:22:03] sheriff contract rates and actual staff [00:22:06] time. [00:22:08] This resolution also authorizes annual [00:22:10] adjustments tied to the sheriff's [00:22:12] contract rate increases. This ensures [00:22:14] that the fee remains accurate without [00:22:16] requiring repeated council action. [00:22:19] Staff recommends adoption of resolution [00:22:22] number 2025 next in order amending the [00:22:25] vehicle impound cost recovery fee and [00:22:27] adopting the new DUI vehicle impound [00:22:29] cost recovery fee. This will ensure the [00:22:31] city recovers its costs and complies [00:22:33] with state regulations. Thank you. And [00:22:35] staff are happy to answer any questions. Brad Anderson, city I [00:22:49] currently live in the city of Ass for a [00:22:51] little bit longer. Anyway, um, I wanted [00:22:53] to speak on this public hearing item [00:22:55] number 6A and concerning the staff [00:22:59] report that was just mentioned. Uh I'm [00:23:02] opposed to this mainly because of the [00:23:04] extreme costs uh related to the DUI [00:23:08] uh and other intraction policy. Uh I do [00:23:12] read through the city [00:23:16] I guess agenda packets quite often and [00:23:18] there are a lot of DUI institutes uh [00:23:21] related to the city expenses. I guess uh [00:23:24] I don't know why uh why we're running a [00:23:28] car for the sheriff's department and [00:23:31] other aspects of the motorcycle or fleet [00:23:34] and keeping them upgraded. Uh [00:23:37] not that I'm anti- police, believe me, [00:23:39] but uh I am concerned of those costs and [00:23:42] and how the contract doesn't cover [00:23:45] those. Uh so there are other [00:23:47] administrative fees related to that with [00:23:49] the city and maybe we should look at [00:23:51] that. Uh and and again, this imposes uh [00:23:57] that the contract with the uh with [00:24:00] Riverside County Sheriff's Department [00:24:02] oversees or adjust this adjust this u uh [00:24:06] fee structure as time goes by and uh and [00:24:11] it will just increase. I'm sure I I [00:24:13] would like the city council to review [00:24:16] this uh you know as as cost increase and [00:24:20] not just give blanket authority to have [00:24:23] it raise uh without mention to the city [00:24:26] population that pays for a lot of that. [00:24:29] So that's my qualms. Uh again, we're [00:24:33] going from 145. Not that I'm a DUI [00:24:36] supporter, believe me. Uh but uh I think [00:24:40] a thousand some dollars uh in in city [00:24:42] cost, I believe. Uh that's extreme. And [00:24:45] I and maybe we need to monitor why [00:24:47] that's so high. And that's all I have. [00:24:50] Oh, I did write some public comments. I [00:24:53] am concerned about how the public [00:24:54] hearing items are being discussed and [00:24:56] written comments are being demanded [00:24:58] prior to the meeting. says if I if I [00:25:01] submitted them now they will be seen and [00:25:04] a public hearing I this is part of the [00:25:06] public hearing is the testimony and if I [00:25:09] did submit written comments they should [00:25:10] be accepted and read and that's what I [00:25:13] have. [00:44:51] The city city's federal crimes against [00:44:54] me catapulted me into a long-term [00:44:56] desperate struggle in self-defense. [00:45:00] Being victimized at all levels, from [00:45:03] tenant bullies up to the mayor, the [00:45:06] mayors, three mayors or so. It's been [00:45:11] taxing and traumatic a life and death [00:45:13] situation for me. The city defrauded me [00:45:16] of my affordable head housing when I [00:45:20] where I had lived since May 2018 when [00:45:22] Mr. Hagermanerman started his position. [00:45:25] However, I have been a citizen of the [00:45:28] city of Rancho Mirage since 2009 and I [00:45:31] consider it my home. Of course, the [00:45:34] city's motive for ruthlessly persecuting [00:45:38] me was unjustified and sadistic revenge. [00:45:42] In October 2019, the city scapegoated me [00:45:46] falsely, claiming I was an In-N-Out [00:45:49] burger protester. Furthermore, the city [00:45:52] resented my concerns about unhealthy [00:45:55] unshielded lead lighting. The city [00:45:57] didn't get it. They didn't even try.
